It very obvious that even the most careful drivers can engage in an accident with those drivers who drive recklessly. The sad story of engaging in accidents with other drivers is that you may not receive a settlement from an insurance company.  This is especially the case if you choose to go with the cheapest auto insurance quotes blindly.

Actually, if someone else crashes into you, you should make a claim against their liability insurance and this is called a third-party claim. Of course, you’re the third-party to the other driver and their insurance company. As a result, let’s look at how you can file a car insurance claim.

Making an Insurance Claim against Someone Else

In case you’re on the road and someone crashes into you, you’ll probably need to make a claim against their liability insurance in the simplest scenario. The claim you make is called a third party claim since you’re the third party to the other driver and their insurance company.

However, the other person’s insurance provider will obviously process the claim so you should not count on a quick payment. Since the insurer might also want to investigate the accident to determine whether their client was truly at fault, it’s best of interest to have some evidence like taking photos at the scene of the accident.

You Could Sue

You can also hire a lawyer and sue the other driver if you want to get compensation from crush on the road. You may indeed need help to establish that the other person was truly at fault especially if they begin finger-pointing claims at you. Some essential items such as the police report, photos from the scene and contact information for any witness can help you prove you weren’t to blame.

Although each state has different rules, most local governments have some version of small claim court. In these courts, filing fees are usually reasonable and there is always a wait time before the hearing which is about a month or two. If you decide to sue the other driver, then you should have all the information of the incident available.
