You may indeed need help to establish that the other person was truly at fault especially if they begin finger-pointing claims at you. Some essential items such as the police report, photos from the scene and contact information for any witness can help you prove you weren’t to blame.

Although each state has different rules, most local governments have some version of small claim court. In these courts, filing fees are usually reasonable and there is always a wait time before the hearing which is about a month or two. If you decide to sue the other driver, then you should have all the information of the incident available.
